The Supreme Court (SC), upheld the validity of the candidacy of Camarines Norte Governor Edgardo Tallado in the last mid-term elections.
In a statement Thursday, the SC en banc, voting 8-6, granted Tallado’s questioning his disqualification by the Commission on Elections (Comelec) from the province’s gubernatorial race in the May polls.
Concurring with the decision penned by Chief Justice Lucas Bersamin, which overturned the Comelec’s decision, were Associate Justices Diosdado M. Peralta, Alexander G. Gesmundo, Andres B. Reyes Jr., Jose C. Reyes Jr., Amy C. Lazaro-Javier, Henry Jean Paul B. Inting, and Rodil V. Zalameda.
Meanwhile, those who dissented were Senior Associate Justice Antonio Carpio, Associate Justices Francis Jardeleza, Estela M. Perlas-Bernabe, Marvic Leonen, Alfredo Benjamin Caguioa, and Rosmari Carandang.
Tallado was disqualified by the Comelec en banc, prompting him to take the case to the SC, which issued a status quo ante order, allowing him to run in the May 2019 polls.
The SC was asked to rule whether there was an involuntary interruption to office after he was dismissed from the service by the Office of the Ombudsman.
Tallado sought to run again for governor for the “fourth time”, arguing that his three terms in office were interrupted due to his dismissal from the service by the Office of the Ombudsman.
The Comelec en banc affirmed the ruling of its First Division canceling the Certificate of Candidacy (CoC) of Tallado, in favor of a petition filed by Norberto Villamin and Senandro Jalgalado who argued that the mid-term elections would be his fourth term. (PNA)
